Templ8 / We / Us
Templ8.email and its operators, representatives, and contractors who provide the Service under these Terms.
Service
The Templ8.email online platform, including the email template editor at fly.templ8.email, the template archive and exploration tools at templ8.email, and all related websites, APIs, and features.
Editor
The drag-and-drop email template builder available at fly.templ8.email, where Users create, customize, and export email templates.
Archive / Explore
The curated collection of publicly available email templates and newsletters displayed on templ8.email for design inspiration and research purposes.
User / You
Any individual or entity that accesses, browses, or registers an account to use the Service.
Account
A personal profile created upon registration, containing necessary details for accessing premium features of the Service.
Content
Any text, images, designs, templates, code, or other materials uploaded, created, or submitted through the Service.
Third-Party Content
Email templates, newsletter designs, brand logos, and other materials displayed in the Archive that are owned by their respective creators and rights holders.

1. Acceptance of Terms

By accessing or using Templ8.email, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to all of these Terms, you must not use the Service.

We may update these Terms from time to time. We will post the revised version on this page with an updated “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Service Description

Templ8.email provides two core services:

  • Email Template Editor — A professional drag-and-drop builder that allows Users to design, customize, and export responsive HTML email templates for use with any email service provider.
  • Email Template Archive — A curated, searchable collection of real-world email templates and newsletter designs sourced from publicly available marketing emails. The Archive is provided for design inspiration, research, and educational purposes.

The Service is provided on an “as is” and “as available” basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Account Registration & Eligibility

To create an Account and access premium features, you must:

  • Be at least 18 years old or the age of legal majority in your jurisdiction.
  • Provide accurate, complete, and current registration information.
  • Accept and comply with these Terms and our Privacy Policy.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must notify us immediately at support@templ8.email if you suspect any unauthorized use of your Account.

Prohibited Users

Templ8 reserves the right to refuse service, suspend, or terminate accounts of individuals or organizations that promote hate speech, violence, or illegal activities; engage in fraudulent, deceptive, or abusive behavior; or otherwise violate these Terms.

4. Email Template Archive & Third-Party Content

The Archive displays email templates and newsletter designs collected from publicly distributed marketing emails. These materials are displayed for informational, educational, and design inspiration purposes under applicable fair-use and fair-dealing principles.

Important notices regarding the Archive:

  • Ownership. All Third-Party Content displayed in the Archive remains the intellectual property of its respective owners. Templ8 does not claim ownership of any Third-Party Content.
  • No endorsement. Display of any brand's email in the Archive does not imply any endorsement, sponsorship, affiliation, or commercial relationship between Templ8 and that brand.
  • Informational purpose. The Archive is provided solely for research, design inspiration, and educational use. Users must not reproduce, redistribute, or use Third-Party Content for commercial purposes without obtaining permission from the original rights holder.
  • Brand removal. If you are a brand or rights holder and wish to have your content removed from the Archive, please submit a request to takedown@templ8.email. We will process removal requests promptly, typically within 5 business days.

5. Copyright & DMCA Takedown Policy

Templ8 respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA) and equivalent EU/international copyright frameworks. If you believe that content on our Service infringes your copyright, you may submit a takedown notice.

A valid DMCA or copyright takedown notice must include:

  1. Your physical or electronic signature (or the signature of a person authorized to act on behalf of the copyright owner).
  2. Identification of the copyrighted work you claim has been infringed.
  3. Identification of the material on our Service that you claim is infringing, with sufficient detail for us to locate it (e.g., URL).
  4. Your contact information (name, address, telephone number, and email address).
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will review and respond to valid notices promptly, typically within 2–5 business days. Templ8 reserves the right to remove or disable access to allegedly infringing content pending investigation.

Repeat Infringer Policy

In accordance with the DMCA and applicable copyright law, Templ8 will terminate the accounts of users who are repeat infringers in appropriate circumstances. A user may be deemed a repeat infringer if they receive two or more valid takedown notices. Templ8 reserves the right to terminate any account at any time if, in our sole discretion, the user has repeatedly infringed the copyrights of others.

6. User Content & License

Templates and email designs you create using the Editor are your property. You retain all rights to your original Content, subject to the limited license below.

  • License to Templ8. By using the Service, you grant Templ8 a non-exclusive, worldwide, royalty-free license to host, store, cache, and display your Content solely as necessary to provide and operate the Service. This license terminates when you delete your Content or close your Account.
  • Your responsibility. You represent and warrant that you own or have the necessary rights, licenses, and permissions for all Content you upload, create, or share through the Service, and that your Content does not infringe the intellectual property or other rights of any third party.
  • Templ8 templates. Pre-built templates provided by Templ8 remain our property. You may use and modify them to create your own email designs, but you may not resell, redistribute, or sublicense unmodified Templ8 templates as standalone products.

7. Intellectual Property

The Service and its original content (excluding User Content and Third-Party Content), features, functionality, software, design, logos, and trademarks are and remain the exclusive property of Templ8 and its licensors. They are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software, nor may you reverse-engineer or attempt to extract the source code of the software, unless applicable law permits it or you have our written permission.

8. Prohibited Uses

You agree not to use the Service to:

  • Create, distribute, or facilitate spam, phishing, or unsolicited bulk email.
  • Upload or distribute malware, viruses, or any other harmful or malicious code.
  • Violate any applicable local, national, or international law or regulation, including data protection laws (e.g., GDPR, CAN-SPAM, CCPA).
  • Infringe the intellectual property, privacy, or other rights of any third party.
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
  • Scrape, crawl, or use automated means to extract data from the Service beyond what is permitted by these Terms or applicable law.
  • Create content promoting violence, hate, discrimination, terrorism, or any illegal activity.

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your Account without notice or refund.

9. Payments & Subscriptions

Certain features of the Service require a paid subscription. By purchasing a subscription, you agree to the following:

  • Pricing. Current pricing is displayed on our pricing page. All prices are exclusive of applicable taxes unless stated otherwise. We may update pricing with reasonable notice.
  • Billing. Payments are processed through our third-party payment processor. You must keep your payment information accurate and up to date.
  • Refunds. Our Refund Policy describes the circumstances under which refunds may be issued.
  • Account suspension. Failure to process payment may result in suspension or downgrade of your Account until the balance is settled.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Templ8 does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee that the results obtained from the use of the Service will be accurate or reliable.

With respect to the Archive, Templ8 makes no representations or warranties about the accuracy, completeness, or currentness of any Third-Party Content displayed.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEMPL8, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to use) the Service;
  • Any conduct or content of any third party on the Service;
  • Any Third-Party Content obtained from the Service;
  • Unauthorized access, use, or alteration of your Content or transmissions.

In jurisdictions that do not allow the exclusion or limitation of certain warranties or liability (including the EU and the Netherlands), our liability is limited to the maximum extent permitted by law. In any case, our total aggregate liability shall not exceed the amount you paid to Templ8 in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Templ8 and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including reasonable attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any copyright, property, or privacy right; or (d) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive the termination of these Terms and your use of the Service.

14. Termination

We may suspend or terminate your Account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your Account, you may do so by contacting us at support@templ8.email.

Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Force Majeure

Templ8 shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, strikes, government actions, natural disasters, power failures, internet disruptions, or cyberattacks.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.

If you are a consumer in the European Union, you may also use the European Commission Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Nothing in these Terms affects your statutory rights as a consumer under mandatory EU/NL consumer protection laws.

17. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck or modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Templ8 regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
